[Ask a Girl] Legal Question

    I'm not sure where to post this so feel free to move it... But I have a question for anyone, guy or girl.

    I have a female friend who is 19 and is interested in doing some "adult modeling" (porn). She answered an online ad from a guy claiming to be a talent scout/manager for a porn production company. During the interview the man requested that she have sex with him on tape as an audition and so he has something to show his producers to verify her 'talents'.

    Well, she did have sex with him and now the guy has dropped off the face of the earth. Now I'm thinking the company he claimed to work for was fake and was just using this ruse to sleep with desperate women.

    Does she have any legal recourse? Or is she just up shit's creek because she's naive and didn't get anything in writing or anything? I mean, she's 19 and performed the sex voluntarily, but because it was under malicious circumstances does that change anything? What can we do?!?

    I haven't been able to find anything on the internet so if anyone has any words of wisdom or can share their thoughts on the matter, it would be greatly appreciated. And this happened in FL, if that changes anything legally. Thanks for your time.

    Sounds like she's SOL, hopefully she learned a life leason out of this.

    They show those fake audition scam videos on all the tube sites. Exactly the scenario you describe takes place. There is no shortage of girls who will strip and engage the fake agent in sex, without a friend or any sort of security. When it's over the girl gets rushed out with a laugh and a promise.

    The same guys are in most of them(voices only, no faces) and they obviously know how to disappear so they can set up again and do it all over.

    All she can do, unfortunately, is to chalk it up to experience. If ever he was found, the tape is proof that the sex was consensual. She may even have signed some type of release as well.

    She really should consider getting into another profession.

    Yeah, I've seen plenty of videos of this exact nature on YouPorn. I figured it was just staged, but it doesn't seem a huge stretch that it could be real.

    No matter what, if the whole thing was a ruse, those agreements would/should be null and void. The fact that the guy is not a "talent" scout, among other things is fraud. It would probably come down to local laws, but I'd think a good lawyer would rip those guys to shreds for such an operation.

    If there's no signed agreement or standing policy that the victim is informed of that the party violates, it's not fraud.

    I'm sorry but your friends needs to hear this. She is a fool. This is the equivalent to me walking up to a guy in a bar, saying, "Wow, did you hear the price of Gold is spectated to go through the roof? I'm a stock broker, and if you give me all the cash on you right now, I can double it by tomorrow. Of course, you don't know me and we haven't signed an agreement. There's no release, contract, notary, evidence, or obligation of commitment. You don't know if I even have an office, I don't even sound like a stock broker, and I'm kind of drunk. It's a definite win scenario, though." And him ACTUALLY GIVING ME everything he has.

    Since she willingly engaged in sexual conduct, it isn't sexual assault. Since she didn't sign an agreement that they are obligated to legally follow, it isn't fraud. Since she was filmed with full knowledge and consent, it isn't invasion of privacy. And since she agreed to the terms of their engagement, they have full rights over the property of the video.

    Talent Scout for a porn production? That isn't a Scam, it's a Pickup Line.

    If I remember a show on TV a few years ago things happen in a known place with a crew, not alone with someone. Food fot thought.
    As for the SOL comment, I tend to agree with it.

    Ok... well i appreciate all your input. She contacted a lawyer who wasn't even sure whether or not it was fraud. He just said it's moot since she's unable to find the man and probably doesn't even have his real name.

    Definitely life experience points for her.

    Keep in mind that calling yourself a "talent scout" is much different than calling yourself a lawyer. There is no licensing body for talent scouts, particularly when it comes to porn. All it really takes is what the guy did - promise to try to get her into the business, and ask her to provide something he can use to show "potential producers". He could just say that his "method" of showing to "potential producers" is to post it on porn sites and maybe someone will contact him about it. That is why so many guys are doing it. Even being difficult to reach can be explained by "I was not profitable so had to close down the business" - which leaves him free and clear to reopen the same "business" under a different name.

    A signed agreement, if used, would not constitute fraud. All those things really say is that the video is being created with her full consent, and he has the right to show it to others. That would cover putting it out on the internet. Someone "eager" to get into porn is going to be more than willing to sign it without asking questions.
